Terms and conditions for using Web4Future services

Web4Future provides software development and technology services to clients worldwide. We have the responsibility to protect each client and provide them with the best services available. The following guidelines were designed to ensure these services.

1. Acceptance of Terms

By accessing and using Web4Future's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

2. Services Provided

Web4Future offers the following services:

3. Acceptable Use Policy

3.1 Permitted Use

All services provided by Web4Future may be used for **lawful purposes only**.

3.2 Prohibited Content

Transmission, storage, or presentation of the following is strictly prohibited:

  • Copyrighted material without authorization
  • Material that is threatening, obscene, or defamatory
  • Unlicensed software or files
  • Material protected by trade secrets
  • Pirated software or "warez"
  • Hacker programs or archives
  • Child pornography or exploitation material
  • Content that violates any applicable law

**Web4Future will be the sole arbiter as to what constitutes a violation of this provision.**

4. Intellectual Property

4.1 Client Ownership

Upon full payment, clients own all custom work created specifically for them, including:

  • Source code
  • Design files
  • Documentation
  • Database schemas

4.2 Web4Future Ownership

Web4Future retains ownership of:

  • Pre-existing tools and frameworks
  • Reusable components
  • Internal methodologies
  • Generic solutions

4.3 Portfolio Rights

Unless otherwise agreed in writing, Web4Future reserves the right to display completed projects in our portfolio and marketing materials.

5. Project Terms

5.1 Quotes & Estimates

  • Quotes are valid for 30 days
  • Final pricing may vary based on scope changes
  • Estimates are provided in good faith but are not binding

5.2 Payment Terms

  • **Deposit:** 30-50% upfront before work begins
  • **Milestone Payments:** As defined in project agreement
  • **Final Payment:** Due before project delivery
  • **Late Payments:** May result in project suspension

5.3 Project Timeline

  • Timelines are estimates based on provided requirements
  • Delays caused by client feedback may extend timelines
  • We maintain a 100% on-time delivery record for agreed milestones

5.4 Scope Changes

  • Changes to project scope must be documented
  • Additional work will be quoted separately
  • Timeline adjustments may be necessary

6. Client Responsibilities

Clients agree to:

  • Provide timely feedback and approvals
  • Supply necessary content and assets
  • Maintain clear communication
  • Make payments as agreed
  • Provide accurate project requirements
  • Have authority to approve project decisions

7. Warranties & Disclaimers

7.1 Our Warranty

We warrant that:

  • Services will be performed in a professional manner
  • Delivered code will be functional as specified
  • Work will be free from major defects for 90 days post-delivery

7.2 Limitations

We do NOT warrant:

  • That software will be error-free (no software is)
  • Compatibility with all future browser/OS versions
  • Results from third-party services or APIs
  • Specific business outcomes or revenue

**SOFTWARE IS PROVIDED "AS IS" FOR PROJECTS COMPLETED MORE THAN 90 DAYS AGO.**

8. Support & Maintenance

8.1 Warranty Support (90 Days)

Included for free:

  • Bug fixes for issues present at delivery
  • Critical security patches
  • Technical support via email

8.2 Post-Warranty Support

Available for a fee:

  • Feature enhancements
  • Design changes
  • Ongoing maintenance
  • Technical support
  • Hosting management

9. Confidentiality

9.1 Our Commitment

We will keep confidential:

  • Your business information
  • Project details (unless in portfolio)
  • Trade secrets
  • Sensitive data

9.2 Exceptions

We may disclose information when:

  • Required by law
  • With your written consent
  • To prevent fraud or illegal activity
  • To enforce our rights

10. Limitation of Liability

10.1 Maximum Liability

Our maximum liability for any claim is limited to the amount paid for the specific service in question.

10.2 Excluded Damages

We are not liable for:

  • Indirect or consequential damages
  • Lost profits or revenue
  • Data loss (backup your data!)
  • Third-party claims
  • Force majeure events

11. Termination

11.1 Termination by Client

Clients may terminate projects with:

  • Written notice
  • Payment for work completed to date
  • No refund of deposits or milestone payments

11.2 Termination by Web4Future

We may terminate services if:

  • Payment is not received
  • Terms are violated
  • Illegal activity is discovered
  • Project scope is impossible

11.3 Effect of Termination

Upon termination:

  • All unpaid invoices become due immediately
  • We may withhold work until payment is received
  • No refunds for completed work

12. Refund Policy

12.1 Deposit Refunds

Deposits are **non-refundable** once work has begun.

12.2 Milestone Refunds

Milestone payments are **non-refundable** once that phase is completed and approved.

12.3 Dissatisfaction

If dissatisfied:

  1. Communicate issues clearly
  2. Allow us time to resolve
  3. We'll work with you to find a solution

13. Data Protection & GDPR

For EU clients:

  • We comply with GDPR requirements
  • Data processing agreements available
  • We maintain appropriate security measures
  • Data retention policies in place

14. Third-Party Services

Projects may include:

  • Payment gateways
  • API integrations
  • Hosting services
  • Analytics tools

These services have their own terms and pricing. We are not responsible for third-party service failures or changes.

15. Force Majeure

We are not liable for delays or failures caused by:

  • Natural disasters
  • War or terrorism
  • Government actions
  • Internet outages
  • Pandemics
  • Other events beyond our control

16. Dispute Resolution

16.1 Good Faith Negotiation

Disputes will first be resolved through good faith negotiation.

16.2 Mediation

If negotiation fails, we agree to mediation before litigation.

16.3 Jurisdiction

These terms are governed by Romanian law. Disputes will be resolved in Oradea, Bihor, Romania.

17. Indemnification

You agree to indemnify and hold harmless Web4Future from any claims resulting from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of third-party rights
  • Content you provide

18. Modifications

We reserve the right to modify these terms at any time. Changes will be:

  • Posted on this page
  • Effective immediately for new projects
  • Announced via email for existing clients

Continued use of our services constitutes acceptance of modified terms.

19. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These terms, along with any project-specific agreements, constitute the entire agreement between you and Web4Future.
